Not in the Magistrates court in South Australia. Magistrates there can do whatever they like. They are not even answerable to the chief magistrate. There has been instances where they have made the opposite decision in identical cases for no other reason than they have a personal issue with the other magistrate.
I got that straight from a barrister first hand.
I don't believe precedents even mean much in the supreme court here. In the USA curtainly, Not here.
