Board Found at Malabar beach Sydney

As luck would have it, one of my customers was approached outside my shop by a fisherman that has found an Underground board at Malabar beach.
I spoke to him bacause I probably know who it belongs to, but he would not part with the board, not even for $50, he says he is going to put it on ebay.

He said if the owner calls him and offers him something more than $50 I guess he said he would probably return it.

I have seen the board through his car window, I know the size, year model an colour.

I have the Fishermans name and contact number here at the shop, contact me if you think it is yours. Ph KP on 95296894

send the ole bill round on im..... thats stealing.
if his car broke down whilst he was pulling his boat and he had to leave the trailer behind i know i wouldnt be able to hitch his trailer to my car. then sell his boat on ebay
or maybe karma may get him ...

If you see the board on E-bay. Report him. Then leave a message on the questions section telling people not to buy it coz its STOLEN!

It is theft indeed - it is a crime NOT to hand in something you find to the police - just ask the guy who got done for the $$$ in a bag under his desk which he "allegedly" found - the cops charged him for not handing it in.

Steve are you gonna pass his details on to the police for us?

I would him $50 to $100 if he found my board and went to the trouble of contacting Steve.But any more and that would be taken the piss.If it comes on E bay I bid it up and leave him with it. Hope the board gets back to its Owner.

This sucks and I wish I had been a bit quicker witted, but I was busy with customers............
I have just taken it or convinced people that the board is mine, and then located the owner in the past.

I just called Rockdale police, and will be calling there to make a report and hand over this wackers details today.

According to the police failing to hand in things found anywhere is regarded as theft.

Hopefully it all comes out as a happy ending.
Went to the Police at Rockdale today with the person who owns the board, we gave the desk sergeant the info and he called the "finder" straight away while we were there, he got his home and work addresses and will be paying "finder" a visit within the next 24 hrs.

The owner is not going to press charges but he could, he just wants his board back asap. He had called "finder" and offered $100 but that was still rejected, the cop was offered the board for $150ish!!

So if you find anything of value anywhere and it does not ammter if it is on water, on a beach or on land, you must contact the Police and hand the item in. If not you can be charged with "theft by finding"!!!!

Actually if an owner isn't found its a different situation,
A salvor obtains a right to possess the property but not the right of ownership, and the salvor holds the saved property for the benefit of the rightful owner. However, if the law of "finds" applies, then the finder actually obtains possession and ownership of the property. In the case of a "find" the court does not have to set a value because by definition the finder takes title to the property free and clear of all other claims. Remember the rule, "finders keepers losers weepers".

Well there is always an owner of an Underground board wanting it back.
In this case one had been into the shop on the day the fisherman was trying to flog it over the road from the shop.
We went to the Police yesterday, and they have just returned to board to the shop, I have just called the very grateful owner.
Fisherman was not charged just warned to hand things he finds in to the Police, if no owner is found within a certain timeframe, then he can take title to the goods, but they have to be handed in the the Police first, according to the Police.
Regardless of the exact law that is what I would do, wouldn't you?

His harness broke, it was getting dark, there was a strong run out tide, everything conspired against him, and yes he did not have his real leash clipped on!!!!!
It was definitely his board because it had a repair on it that I had done that made it unique.
I wonder whether that fisherman has learned anything?
