Former world champion surfer Sunny Garcia will return to Australia to defend assault claims stemming from an alleged surf-rage incident.

Mr Garcia's lawyer Chris Nyst says his client, who lives in Hawaii, denies any wrongdoing over an altercation at a Gold Coast pro-surfing event in February, and will co-operate with police.

"I can confirm Queensland police have contacted me today to advise a warrant has been issued for my client Sunny Garcia ..." Mr Nyst said in a statement.

Mr Garcia and world title contender Jeremy Flores from France became involved in a fight with a young local surfer after Garcia's teenage son was allegedly threatened while he and Flores were free-surfing near the contest area for the Burleigh Breaka Pro.

An amateur cameraman who recorded the fight claimed he was attacked by Sunny Garcia soon after. The cameraman lodged an official assault complaint with police, but soon withdrew it.

The latest police matter involves the young surfer who was allegedly assaulted.

Mr Nyst said he was confident his client would be exonerated.

"Mr Garcia has always maintained he is not guilty of any wrongdoing in the matter," the lawyer said.

"From day one he made it clear he became involved in an altercation to defend his 16-year-old son.

"As a father he considered himself entitled, and indeed morally obligated, to do that.

"Following the incident he made himself available to police investigating the matter, and he has not sought to hide or evade the issue in any way. No charge was laid at the time, and he subsequently returned to his home in Hawaii.

"Given today's development Mr Garcia intends to return to Australia in due course, and when he does he has instructed me to reveal the full facts of the incident, and its lead-up, to the court.

"When that happens I'm confident he will be exonerated of the charge."

Police would not comment other than to say a 41-year-old man was assisting them with inquiries into the incident in February.

"We can confirm we received a complaint in regards to the incident that occurred earlier this year," a police spokeswoman said.

"A 41-year-old man is assisting police with inquiries."

Ban him from competing in australia, just ban him from ever coming back , same respect as a rugby league xxxxwit !! i believe the cameraman had death threats so he bolted back to brasil and withdrew the charges. Lets send koby abberton in to demoralise him in hawaii, took care of johnny boy gomes in his youth.
