I don't know what the laws are in Australia, but in the UK you are required to report your findings to the police. If the property is not claimed after a specified period of time it's yours.
I can sympathise with not finding your board - sometimes you stack, get dragged downwind a bit and with the sun shining over your back you just can't see the board. I imagine that is a pretty common problem in WA with the sunset and the prevailing summer wind being from the same direction.
Some boards are just easier to see in the water, whether they have a bright colour scheme or even just sit lower in the water. eg. Never really had a problem with my Naish Sol but my Cab Custom is an absolute dog to find sometimes, even with a fluoro green rail.
