GoPro silver 3 has a built in kook and poser detection system,

you will have to disable from main menu and download the
"i'm special filter "to recover lost footage.

haven't had that problem and assuming it was actually recording and the files just appear to be missing (check file sequence numbers) then a recovery program like "Recover My Files" or disk uneraser should be able to find them (just make sure NOT to take any more video or photos until you've run the recovery tool).

I have had great success on cameras and hard disk using "Recover My Files"
