If you went out and got into trouble, the question would be asked to him why he didn't do anything to stop you in the first place, it's on his shoulders at that stage. If you went out against his instructions and things went pear shaped it's your fault, he has done his duty of care and can't be sued.

Yep I figured it was liability issue, but I thought it was odd that they would just tell you that the beach was closed, and you could not go out. I thought they might just say that if you go out they cannot rescue you.
There were also a whole heap of surfers out that day further up the beach.
Question though: if you do get in trouble and it is too rough for the jetski or boat rescue what happens? (Apart from drowning) Who pays for the chopper?
