Kiting allowed at Cott for WAKSA members

Been in Port Douglas for the last week for a bit of work, so have missed this thread, but will try and add some light as I attended most of the council meetings etc over the last 8 months. Firstly, and I suppose most importantly. The council had strong pressure from certain Cottesloe residents to ban kiting in the total shire. The council has in there wisdom decided to allow kiting , by changing their by-laws and including kiting into there system. I'm afraid it's not a free world. ie not surfing in Cott in summer/ no boats within 200m of shore etc etc. In fact we are illegally kiting in Cottesoe, until they change their by-laws. The shire by-laws define surfing,windsurfing,booggy boarding, canoeing, fishing etc,etc. We are now becoming legal to kite in Cott. IE, the council has off loaded all risk and chance of being sued. What if you kite their without council approval. The council has now legally washed it's hands towards kiting and legally set in place minimum standards for kiting in the Shire. As I was told " if you guys are mad enough to kite in Cott, do so at you own risk". If you wish to kite in the Cottesloe Shire and hurt yourself and are not part of WAKSA,(or you can take out your public liability insurance.) YOU will be held 100% responsible. If you hurt any one else , lose a kite, you are responsible.
Past this if you decide kite in restricted zones or cause problems with swimmers or other water users, the cottesloe council can ban us totally at the very next council meeting.

Kiting has been totally banned recently at beaches in Adeliade/Hawaii/and parts of Europe. Councils are looking at kite useage in Melbourne and Gold coast at the moment.
So at the end of the day either join WAKSA(there is no conspiracy theory)organise your own INDEM Insurance. Or kite in other Shires.

Joined WAKSA today.....cheque's in the mail.
Still feel really fu%ked over. I've lived in Cott for 10 years, have paid outrageous rates, and all for ****er councilors who just want to make $$$$$$'s out of property development, C**nts! (KEEP COTT LOW......UNLESS U CAN JUMP)

But can anyone explain 2 me why we should give up the safest launching & landing area just to keep happy the Lone Ranger??

I dont doubt that WAKSA members have worked hard for a result that ensures access to Cott but is there a risk that once one beach is controlled in this manner there will be impetus for the council to follow suit on the other beaches?
I notice someone said that if you've got AKSA membership and are a WA resident your covered but does that mean that as a non WA resident but a AKSA member I wouldn't be? I fancy a holiday in WA some time but as a Melbourne Kiter with a view to joining AKSA that would be my position. Perhaps the various associations could arrange reciprocal rights (if not already existing) with each other so that we all dont run into problems when on interstate holidays.
Having said that, I'm not aware of anywhere in Vic having such laws at present and call me an ostrich, but if the reciprocal issue would require AKSA (or any local organisation) getting the OK from the council before they are even considering a ban, then I'd say there's no need to bring it on planting the seed in their minds.

na from what I understand if you have AKSA membership your cover'd if your a WA resident or not ?

I too am interested to see what the council's do as my local spot Woodmans point, which is 5k's from my new block of land, is luckly enough on a nature rezerve. However the surrounding areas are marked for major development into a cott/scarb/freo style ritzy suburb. But I feel if we act now we can get established long beforwe they do....

a WAKSA member *is* an AKSA member.

irrespective of exactly what the exact arrangement is (maybe this needs some clarification?), the council's concern is the kiter having public indemnity insurance.

i find it amusing that a few ppl have their heads in the sand and bag WAKSA for securing continued beach access, rather than letting the council enforce a total ban... wtf

The Ranger is on our case because of complains of kite boarding in Cottesloe. A number of letters werer sent to the council by Cottesloe house holders across the road. ie kiters frighting swimmers, kites hitting bathers on beach at cottesloe, kiter ending up over road on golf course and a loose kite ending up wrapped around a house across the road in Cottesloe. Also the kites at the phone box were hanging over the foot path and road when kiters were walking up the beach from cove area. Also a number of people have been hurt at Cottesloe over the last 18 months, a guy was dragged( not a pretty sight I heard)over small groyne and a guy last winter knocked unconscious at the cove. (again he told me that he had no idea how long he was on beach until he was found). As you can see the Ranger had a few issues to deal with, with really got under his skin. Since we have moved to Rosendo street, our interaction with the general public has dropped 90%.
IF all kiters do the right thing by the council , the council has no issues with us kiting at Cottesloe, infact they all like to watch kiting and want it to stay in Cottesloe.

AS was said above. A few rules are better than a total BAN, Also Cottesloe beach, to our of state people friends, is a built up residential area on the beach, with houses 75m from the beach ,with a busy road and walk way between beach and houses. The beach is also a mixture of sand on limestone shallow reef with small outside wind waves. Also in summer our consistant SW wind 6 days out of 7 is between 18 to 30 knots which is side-on shore. And every now and then we get balastic 25 to 35 knot days. The days are hot and windy from 12 noon to 7pm every day. AS you can see its kiting paradise , but I can tell from many days on the water at Cott, that a fully juced up 12 m kite in 25 k winds 50m from a road and houses is pushing the genre. Mix in fast 8m kites with wave riding, kite loops and handle passes, dropped kites and sometimes alot of seaweed to tangle powered up lines, and you may get the feel of Cottesloe. Mix that with 25 kiters in a 50m strech of beach and hey, thats our home spot, to much fun, extreme, social, radical( Damo's handle pass into a double kite loop 25m off the beach), public, close to home,(if you do a big jump close to the beach you hear the screams from the public watching)Cott for 30 kiters is our home beach- WE have all worked hard to save it.
\PS Cott also has some of the best winter waves to rip in Perth when our NW storms come through.

Good on WAKSA, really i hope if my local spot comes under scrutiny and kiting is threatend there that they will do the job and keep kiting there.

Only i wonder what the response from surfers would be if suddenly council said surfing is banned in Cott unless surfers are affiliated to Cottesloe surf club.

Its a sad state of affairs when you cant freely go to the beach and enjoy the things you enjoy without all this crap.

Thanks Jonno, Cottesloe sounds great Now I'm suss, dont you guys normally dissuade us 'blow ins' from clogging up your beaches? Cott must be crap - there must be a real pearler down the road.
Sounds like WAKSA are doing a great job by being proactive and involved in the process. My 'ostrich' comment was made because I anticipated that my comments could be misunderstood. I fully support a proactive approach .....where necessary. I'm just suggesting that we may want to think twice before unecessarily pointing out possible legal exposure of local councils (in other regions or states) which may not have already been concerned or investigating the idea of bans. I'm not suggesting disengagement from the council but that we keep our ear to the ground and work with them before the cloud is overhead.

To those doubters who assume third party liability insurance ie WAKSA or AKSA memebership is a hardship just thought I'd let yoy know about the solution that Hayling Island [Englands South Coast ]council imposed on kiting and only after much effort to resist a proposed total ban. Last year it was open access. This year there is a large sign displayed on the beach saying you need 1 third party insurance and 2 to be a member of the Hayling Isand club [cost $70].With that kind of solution you will soon need to be a member of the local club at every beach you wish to kite at.

Now think about it. Sooner are later all councils are going to move to impose some sort of controls on their percieved and untested liability risk from kiting. The Cottesloe Solution could be repeated state and probably nation wide, ensuring that not only do you cover your own ass against liability [and potentially losing the family home], you can kite anywhere in Oz. Councils will have much less excuse to impose total bans when workable solutions elsewhere.

Just a quick question...... can we still do downwind runs on the marginal days (provided we have WAKSA membership) what is the councils views on this subject. Obviously the usual rules apply ie not within 200m from shore etc. Has anyone broached this subject?

Southy as i understand the Cot by-laws only cover the first 200 meters from the beach so that means if you launch at leightons and stay 200m off shore as you go thru the Cott shire (note you need to stay 200m away from main grone thru to North cott surfclub regardless) you should be right and i would gues would not have to belong to WAKSA.

But I could be mistaken. It would be great if someone from WAKSA could clarify this.

Last two days would have been great runs from city beach to trigg, lightish wind and good swell. What are you up to this arvo????

I'm bloody flying........I've been on arvo's all weeks........I've got tomorrow off, however I think the winds not going to come in !

I'm not working much next week and the families away in Kalbarri, so I'm praying for wind every day......

Oh yeah the boys & I R heading up very early Sat morning, so have the bacon & eggs cooking !

Shane is correct. Greater than 200m offshore is DPI jurisdiction.

Be aware that technically if you go more than 400m offshore that you should be wearing PFD1 and carry flares to be legal - DPI have issued warnings to a few people already and the Water Police have expressed concerns to WAKSA over a number of kite surfers that have had to be rescued more than 400m out and did not have the required safety gear. Offenders can be given on-the-spot fines or prosecuted.

To do a down-winder past the rifle range @ swanbourne when red flags are flying you must go outside the range template - more than 400m out to sea - see current nautical charts for details.

The authorities often turn a blind eye (eg it is also law to wear a PFD2 or 3 inside 200m from shore for windsurfers and kite surfers - same as is currently enforced in VIC, SA and NSW) but if kite surfers start becomming a problem here they have threatened to apply the full force of the law.

If we don't give people a reason to complain then things will be sweet.

hey, is there any chance of getting an online mpayment system on the waks website so that we can payby credit card(if there is then i have missed it) its just otherwise things can be a bit difficult for those without cheque accounts. or would can we be able to transfer the money directly into the account
