If I was the guy on the beach I'd at least be expecting a carton as a sorry gesture. The truth in the matter is exactly what the heading says. Regulate yourself and check your gear regularly before we have to get regulated. Complacency is the root of many deaths and accidents. If it had been my kid that was hit by the bar and lines or someone elses kid then the situation would have been different.

I don't really know how it all works but it would be nice to think that if the poor guy needs a head xray or scan it would be nice if insurance paid for it... isn't that exactly what its for??
Yeah, that's what I was driving at. I'm not talking about trumped up lawsuits where people get millions for tripping over a crack in the pavement. The US is a different story to Australia because healthcare is not free for emergency care so I don't think it is relevant to the discussion.
If you crash your car into someone or something you are liable for the damage (property and personal) regardless of gear failure, so why not when something goes wrong with a kite?
The story could have been worse, there could have been some Claret spilled on the beach from the blokes neck and the "just a concussion" could have been a brain injury. And no amounts of apologies or cartons would fix that problem.
I'm a bit affronted by the negative reaction to my response- People has interpreted me as a guy who is looking for a big lawsuit, or is scared of a but of pain. Maybe "authorities" is not the word I'm looking for.
