The ACCC and the demise of the 121 Epirb

In early January the AMIF received a letter from the ACCC issuing a warning that businesses must ensure that they do not engage in any misleading or deceptive conduct regarding the effectiveness of 121 EBIRPS after 1 February 2009.


The letter explained that failure to disclose the ineffectiveness of the beacon after 1 February 2009 would be construed as misleading or deceptive conduct. The ACCC will be monitoring the Marine Industry and will take swift action in relation to any contravening conduct.





I have assured the ACCC that the Marine Industry has taken a responsible approach to the replacement of 121 EPIRBS with 406 EPIRBS, and that I do not expect there to be a need for any ACCC action in our sector.
